1. Who we are

Casafy is operated by Whypes ("Whypes", "we", "us", or "our"). By creating an account or using the Casafy service (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Acceptance

By accessing or continuing to use the Service, you confirm that you have authority to enter into these Terms (on behalf of yourself or your organization) and that you are of legal age in your jurisdiction.

3. The Service

Casafy provides AI-powered photo enhancement tools for real estate listings, including bulk image processing, virtual staging, sky and lighting enhancements, and related features. Features may change over time.

4. Acceptable use

You agree not to misuse the Service. You will not:

• Use the Service for any unlawful, fraudulent, or deceptive purpose;
• Upload content that infringes intellectual property, privacy, or other rights;
• Submit spam, malware, or attempt to probe, scan, or breach security;
• Scrape, reverse engineer, or attempt to bypass technical limits;
• Resell or redistribute the Service without our written consent.

5. Your content and AI outputs

You retain ownership of images you upload. You grant Whypes a limited license to host, process, and transform your content solely to provide the Service. You are responsible for ensuring you have the rights to any images you upload and for how you use AI-generated outputs. AI outputs may contain inaccuracies and should be reviewed before use in listings or marketing materials.

If you believe content on the Service infringes your rights, contact us so we can investigate and, where appropriate, remove the content. We may suspend accounts of repeat infringers.

6. Intellectual property

The Service, including its software, models, branding, and documentation, is owned by Whypes and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan.

7. Payments and subscriptions

Payments are processed by Stripe. For checkout sessions where end-to-end compliance handling is enabled, Stripe acts as Merchant of Record and handles tax calculation, collection, and remittance, as well as billing-related customer support. Whypes remains responsible for the Service itself. See our Refund Policy for cancellation and refund details. Subscriptions renew automatically until cancelled.

8. Service availability

We work hard to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied.

9. Limitation of liability

To the fullest extent permitted by law, Whypes' aggregate liability arising out of or in connection with the Service will not exceed the fees you paid in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel your subscription at any time from your billing page.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Whypes is established, without regard to conflict-of-law rules.
